An accountant's approach to a legal remedy
Delayed-payment claims are won on numbers and documents: what was supplied, when it was accepted, what was paid and what the law adds on top. That is accounting work, done to the standard a Council and a court will test.
CA Akshay Daiya
Chartered Accountant · IBBI Registered Valuer
I am a Chartered Accountant (ICAI membership no. 430882) and an IBBI Registered Valuer in the Securities or Financial Assets class (IBBI/RV/06/2025/15867). My work sits where accounts meet disputes: reconstructing what is owed from ledgers, GST and TDS records and delivery documents, and putting a number on it that survives cross-examination.
MSME delayed-payment claims are exactly that problem. The MSMED Act gives micro and small suppliers one of the strongest collection remedies in Indian law, but a claim is only as good as its acceptance dates, its interest working and its answers to the buyer's objections. I help suppliers prepare and pursue those claims, and help buyers stay on the right side of the same rules.
I also build software for CA practices at catool.co.in.
How I work
- Assessment before filing. Eligibility, documents and limitation first. If the MSMED route does not fit, you hear that first.
- Evidence-led claims. Every invoice tied to proof of acceptance, and interest computed invoice by invoice.
- Settlement first, arbitration-ready. Most buyers pay once the number and the law are laid out clearly.
- Written scope and fees. Agreed before work starts. Fees are not contingent on the outcome.
- Confidential. Client names and matters are never disclosed.
Representation before a Council is as its procedure permits. Court stages, such as a Section 34 challenge or execution, are handled with your advocate.

Tell me who owes you, how much, and since when.
A short message is enough to start. I will reply with whether the MSMED route fits and what the next step is.
